US: Morro Bay considering medical cannabis dispensary ordinance

Since Proposition 64 was passed last November, several cities have been moving swiftly in order to bring cannabis dispensaries into operation. The city of Morro Bay is one of them.

On Tuesday night, the City of Morro Bay will discuss a staff report proposing the possibility of two medical dispensaries. Some locals say the additions would create problems, others see it as a way to help those who need it.

City Councilmember Robert Davis says he is aware of the demand for medical cannabis and of its needs, which are being filled from outside of the city.

Medical use will be considered at Tuesday’s meeting but other concerns will also be addressed, including marijuana smoking regulations, cultivation, commercial operations, taxes, and fees.

Some of the recommendations in the staff report include:

Ban on personal and commercial outdoor cultivation
Ban on recreational dispensaries
Ban on commercial manufacturing and testing
Allow medical marijuana delivery with permitting

The dispensaries could be opening up right next to local businesses in Morro Bay, an area Davis says the public favored at a couple of previous meetings.

"Surprisingly, they said they favored C1 and C2 zoning, which is right here downtown," Davis said.

Ben Bennington, a four-year Morro Bay resident, says he is in favor of medical cannabis dispensaries but to a certain extent.

"If they keep it for medical, they'd be fine because it does work," Bennington said. "I don't care for recreational. That's just asking for more problems."

Marc Frankian, who uses cannabis for his medical needs, says creating this ordinance will put the city ahead of the curve.

“I don't see any reason why you wouldn't support it at this point. You're just opening up access for patients. Medical versus recreational is two totally different animals,” said Frankian.

According to the staff report, the city council should have a workshop on the ordinance for the community by the beginning of September.
