Charges laid, marijuana seized from licensed grow op in NOTL

Larkin Road greenhouse was operating outside Health Canada regulations

Two men are facing drug charges — and more charges are pending — after police seized marijuana from a licensed grow op which is allegedly operating outside the parameters of Health Canada regulations.

Niagara Regional Police charged Zhao Yong, 36, and Cao Li Yi, 30, after they executed a search warrant at the Larkin Road property on Tuesday night. Police say they had been investigating the grow operation for the past several months, and while they learned there were medical marijuana licences issued for the property, their investigation led them to suspect the location was operating outside the parameters of the Health Canada regulations and individuals were unlawfully producing marijuana.

Police executed the search warrant shortly after 5 p.m. on Tuesday and arrested the two males. They located 765 marijuana plants actively growing within a large greenhouse situated on the property. Police say the authorized licence holders were not present at the time the warrant was executed, and the accused had no legal authority to produce marijuana at the address.

"Everything was seized," said Det. Sgt. Paul Blakely of the NRP's Guns, Gangs and Grow unit, noting the plants were about four feet in height. "They were being produced unlawfully."

Zhao and Li Yi were both charged with unlawful production of a controlled substance and were subsequently released from custody on an Officer in Charge Undertaking.

Blakely said they are continuing their investigation and anticipate more criminal charges in the near future.

The Niagara-on-the-Lake Fire Department also attended the scene and Fire Chief Rob Grimwood said upon inspection of the facility, the department identified fire safety concerns.

“We are in the process of reviewing our inspection findings and determining our next steps under the fire code,” Grimwood said in an email to Niagara this Week.
