Malaysia: Upheld: Death Sentence On Indonesian For Drug Trafficking

PUTRAJAYA, April 23 (Bernama) -- The Federal Court here today upheld the death sentence on an Indonesian construction worker for trafficking in 938.91 grammes of cannabis.

Chief Judge of Malaya Tan Sri Zulkefli Ahmad Makinudin, chairing a five-man panel, said the court did not want to disturb the finding of facts of the Johor Baharu High Court over the discovery of a package containing the drug in a car driven by Fernandez.

Chief Judge of Sabah and Sarawak Tan Sri Richard Malanjum and Federal Court judges Datuk Hashim Yusoff, Datuk Suriyadi Halim Omar and Datin Paduka Zaleha Zahari, were the other judges sitting on the panel.

The panel unanimously dismissed Fernandez's final appeal against the High Court decision on Aug 29, 2008, to convict him and sentenced him to death for drug trafficking.

Fernandez, 36, was found guilty of trafficking in the drug at Jalan Kubur in Kampung Bakar Batu, Johor Baharu, at 9.15pm on April 29, 2004.

He was unsuccessful in his appeal to the Court of Appeal which had dismissed his appeal against his conviction and death sentence on Nov 2, last year.
