Malaysia: Two Men Sent To The Gallows For Drug Offence

ALOR SETAR, April 19 (Bernama) -- Two men were sentenced to death by the High Court here today after they were found guilty of trafficking in 938.30 grammes of cannabis two years ago.

Judge Datuk Zakiah Kassim ordered the sentence on Khairulnizan Osman, 29, and Mohd Azizi Hashim, 28, who were charged for the offence under Section 39B (1)(a) of the Dangerous Drugs Act 1952 and sentenced under Sectionn 39B (2), which carries the mandatory death penalty upon conviction.

Zakiah made the decision after she was satisfied that the defence had failed to raise a reasonable doubt on the prosecution's case.

Khairulnizan, a restaurant helper, and Mohd Azizi, who worked with the Seberang Perai Municipal Council, were charged with committing the offence at a roadside in Kampung Sungai Buloh, Tikam Batu, near Sungai Petani at 9.30pm on Jan 27, 2009.

In her judgment, Zakiah said the defence witnesses had contradicted each other in their testimonies and failed to cast a reasonable doubt on the prosecution's case.

DPP Norshuhada Mohd Yatim prosecuted, while the two accused were represented by lawyer A. Saha Deva.
